New York State Division of Veterans' Services

Non-Service-Connected Pension

**NOTE: This section is NOT about the pension paid to retirees. This section focuses on a tax-free benefit provided to certain Veterans by the U.S. Department of Veterans Affairs (VA)**

Did you:

-- Serve on active duty for at least 24 months (or at least 90 days if you entered active duty military service prior to September 7, 1980)?

-- Serve on active duty for at least one day during a wartime era?

** Wartime era service does not require combat zone service. It requires that you served for at least one day during a period when the United States was at war. (A full list of Congressionally recognized wartime eras is found below)**

Are you:

-- Age 65 or older, OR

-- Receiving Social Security Disability (SSD) payments, OR

-- Receiving Supplemental Security Income (SSI) payments, OR

-- A patient in a nursing home, OR

-- Diagnosed with a disabling condition that is “total and permanent?”

Do you:

-- Have assets in your name that are worth less than $129,094?

-- Have an annual income that falls below the income thresholds described below?

If you answered “yes” to these questions, you may be eligible for Non-Service-Connected pension, a tax-free monthly monetary benefit to you from the VA

To meet the “wartime service” requirement for Non-Service-Connected Pension eligibility, you must have served for at least one day on active duty during any of the following time periods:

  • World War II: December 7, 1941, to December 31, 1946
  • Korean War: June 27, 1950, to January 31, 1955
  • Vietnam War [with service in Vietnam]: February 28, 1961, to May 7, 1965
  • Vietnam War [without service in Vietnam]: August 5, 1964, to May 7, 1965
  • Gulf War: August 2, 1990, through the present day

To meet the assets eligibility requirements for Non-Service-Connected Pension, you must not have assets in your name that are worth more than $129,094.

** Your home and up to 2 acres of land surrounding your home are not counted in determining the total value of your assets

** Any vehicles that are necessary for household use are not counted in determining the total value of your assets

** Basic household necessities, such as furnishings, utensils, etc., are not counted in determining the total value of your assets

To meet the income eligibility requirements for Non-Service-Connected Pension, your annual income must be below one of the following amounts:

** Note that the income limits are higher, increasing the ease of qualification, if you meet all of the Pension criteria and also need assistance with any activities of daily living (cooking, bathing, toileting, dressing, medication management, etc.) — qualifying you for Aid & Attendance or if you meet all of the Pension criteria and also cannot leave your home without difficulty, qualifying you for Housebound status.**

** If your income exceeds the listed amount, you may still qualify for Non-Service-Connected Pension if you have unreimbursed medical expenses. A certain amount of expenses that are not covered by any insurance or public benefit can be deducted from your income. Our Veterans Benefits Advisors will assist you with the calculations.**
